Recent years have witnessed a rapid rise in crime rates, which concerns the safety of public. Although many people assume that fixed punishments for each kind of misdeed should be applied, others debate that the circumstances and motivation of individual crime should always be taken into consideration before conviction. In this essay, both aspects will be examined and an opinion provided.
With regard to the former point of views, there are two reasons why the government should give exemplary punishment for each delinquency. First, using harsh punishments like death penalty as stable chastisement will certainly deter people from committing crime. Therefore, the citizens will be highly raised awareness about laws and the crime rates will undoubtedly decrease. Second, this method will probably improve judgment efficiency. Since the sentence for each crime has already given in legislation system, the jury will find much easier to return the verdicts. Additionally, there will be fewer law conflicts due to the consistent regulations established previously.
On the other hand, I strongly believe that the conviction should be based on circumstances and motivations. There is a significant difference between a premeditated murderer and an unintended one who just tried to defense, for example, so it is unfair and unsatisfactory if they are treated the same. Thus, the latter opinion will create a more humane system, which allows the judges to consider carefully and flexibly before accusing someone. Moreover, motivations and circumstances play an important role for adjudicator in deciding the best response. For instance, the intended felon must receive a deserved punishment such as life imprisonment or death sentences; on the contrary, extenuating circumstances such as non-custodial sentence should be applied with the unpremeditated misdemeanor.
In conclusion, even though fixed punishments can be extremely beneficial in enhancing public’s safety, I personally think that the justice system needs to be flexible and fair to penalize unlawful actions, depending on situation and motive.
