Would you consider defending him? // the usage of would

Hi,

Someone is asking a lawyer to defend his son, and I would like to know the usage of the modal 'would' here. Is it a hypothetical question or a courtesy usage?? In the hypothetical case, would the full sentence be, " Would you consider defending him if someone asked you to defend him?"

Thanks so much, Philip! Then how about this one: "There's nothing I wouldn't do to protect him." "There's nothing I wouldn't do to protect him if I had to do it.", or something like that, would be the complete sense of that one? Thanks!

It's a courtesy usage. You have told us that he actually wants the lawyer to do it.
