Would talk vs would have talked

Question

She didn't realize that that her conversation was being recorded at that time; otherwise, she wouldn't talk about the family matters as the law was not the best instrument in dealing with them.

Are you OK with the sentence given? To me, "wouldn't talk" should be "wouldn't have talked".

1. "to deal with" is much better than "in dealing with:
2. I think "had been recorded" is also right (instead of "was being recorded"). There is a possibility, where "had been recorded" would be correct. If the recording had been made a long time ago, but "at that time" she was not aware that there was an old recording. Was the recording made then, or was it an old recording, of which she was unaware? We don't know. (What do you think?)
