Would

I and one of my friends walk into a store and we see a guy having coffee and he looks so serious and mad. After I see that I tell my friend, ‘maybe that guy would be having problems with his girlfriend.’

Are the sentences and the use it would correct? It’s a context not a past action. Thank you.

This is what I say: Maybe that guy is having problems with his girlfriend. "Would" does not fit this situation.
