With or without the article "the" correct?

Hi. Please tell me if we could both use and not use the definite article "the" before the word "evidence." The following is a made-up sentence with a purpose of asking a grammatical question.

This act of stealing is (the?) evidence of what many people call a criminal act.

The word evidence seems misplaced in this sentence. The act of stealing is what many people call a criminal act. This act of stealing is not evidence. One might have evidence of this act of stealing, but the act itself is not evidence. e.g., Fingerprints at the scene provided evidence that X was guilty of the crime of theft.
