Who are or who were

Hi,

Supposing I were an observer in a press conference, and I heard a TV reporter ask the proclaimed winner: Mr. President, how will you deal with Cabinet secretaries who are non-performing?

If I would recount that to a friend, would the below sentence be correct? particularly the use of "are". If I use "were" instead of "are", would that also be correct? Thank you.

The TV reporter asked the President-elect how he would deal with Cabinet secretaries who are/were non-performing?
