Which sentence is better?

Hi,

Please consider these two examples:

(1) I have the contracts, but I think I can't give them to the employees before they ...

or

(2) I have the contracts, but I don't think I can give them to the employees before they...

I was wondering if both sentences are grammatically correct and as such are they interchangeable?
