Which is correct?

He is married to someone who isn't the same religion...
He is married to someone who isn't of the same religion ...
He is married to someone who doesn't have the same religion ...
He is married to someone who doesn't follow the same religion ...

You are right logically, but we often hear and read such things as

John is not the same religion as Mary.
They are not the same religion.


I would hesitate to say it's wrong these days.
