Where vs Were

I need advice on the following sentences. Specifically in relation to the correct use of *where* or *were* as it appears in the sentence:

"Under the penalty regime, where the form is lodged over a month late the entity will be liable for a penalty of $371"

"Where an ancillary return is lodged late, the entity can be liable for a penalty of $170, $340 or $850 "
