What's the difference between the two?

1) He said it like he thought it would make it okay that he was cheating on me while he was married to me.
2) He said it like he thought it would make it okay that he had been cheating on me while he was married to me.

If this refers to something that happened in the distant past,1 means he was still cheating at that point in the past but doesn't 2 mean the same? Are both correct?
