What is the difference?

Hello everybody,

I am going to write two dialogues but I need to understand the difference.

Following situation is going on in the court room.

A (suer) : Your honor, she has no right to sue me. I am suing her!
B (judge) : I am aware that there are countersuits, Mr. Lemming, but I feel it "WOULD" be proper to hear from the lady first.

Okay, now my question is if we use "WILL" instead of" WOULD" in the dialogue "B" what will be difference? Or What is going on in the mind of judge that he is using the word "WOULD" instead of using the word " "WILL" although he is pointing out future time. If we use "WILL" in the situation, sentence will be still correct or not? Please, explain to me in detail. If it is possible, make me understand with examples.

In this situation I consider "I feel it would be proper" a formula of politeness, but the infinitival phrase "to hear from the lady" serves as a sort of condition equivalent to "if we [heard / were to hear] from the lady", so there is also a conditional element present. Similarly, also with infinitives: It would be easy to wait another 10 minutes.

So, when we are not sure about future action whether it will happen or not we use "would" instead of using "will". That is what you are saying Sir? Thanks

That is often what we do. Yes. Sometimes we use "may" or "might" as well in those cases.
