Using should instead of would

#1 It was only in the craziest of times that dictatorship should sound more reasonable than democracy.
Can 'should' be used here instead of 'would'?

#2 He kissed her, albeit only in a state of confusion.
Is albeit used correctly? I know it's an old-fashioned word, but what else would work here to mean he only kissed her in a confused state and there was nothing more to it?
