Use of "Litigation"

Hi

Is the use of litigation natural here? Any other suggestions please?

  1. Any normal person would try to avoid litigation, won't they?
  2. We must try to avoid the expense of litigation and try for a settlement.
  3. We were under serious litigation.

Thanks,

Tom
