Hello!
Could you please take a look which option is better?

In my opinion, the defendant currently is not capable to take care of the child, cannot meet his needs, and it must be determined that the place of residence of the child is with me.

vs.

In my opinion, the defendant currently is not capable to take care of the child, cannot meet his needs, and it must be determined that the child must live with me.
