The usage of "otherwise"

Hi all,
I just want to ask if this sentence is grammatical:
"People have the rights to choose whatever they want even if sugary drinks, which are not scientifically proven to be causing obesity, are otherwise."

This is my original meaning:
"People have the rights to choose whatever they want even if sugary drinks, which are not scientifically proven to be causing obesity, are proven to be causing obesity."

If it's not grammatical, then would there be a better way to write it?
