Can one use:
1) We have to take care of the problem of Tom in a panicked state.
instead of:
2) We have to take care of the problem of Tom being in a panicked state..

Can one use:
3) We have to take care of the problem of your truck in disrepair.
instead of:
4) We have to take care of the problem of your truck being in disrepair.

Can one use:
5) We have to take care of the problem of your house in a poor condition.
instead of:
6) We have to take care of the problem of your house being in a poor condition.

Are you avoiding the use of another clause in the sentences? A clause would be the easiest solution to the problems.

We have to take care of the problem that Tom is in a panicked state.

If you can't do that, choose the sentences using "being," though I am not terribly fond of using "being." That is the better choice, though.
