How come it says 'that which'?

Some patients are willing to accept greater risk than that which normally would be the case.

Some patients are willing to accept greater risk than (that which) normally would be the case.
The words in brackets can be omitted, but either way the sentence is somewhat odd. Maybe some context would help.

But taking the sentence as it is, I prefer something like 'Some patients are willing to accept (significantly) greater risk than most are.'
