Tense used in Indirect speech

Recently I have read the following lines(edited) in a reputed newspaper:

1) While the rebel MLAs said they would meet the President if the Governor did not respond to their letter .

2)Addressing the media, Mr.X said that if the Governor doesn't respond within two days , loyalists would meet the President and submit a memorandum seeking the intervention.

Here ,i have a doubt in the second point if i have to use "didn't respond" instead of doesn't respond .
