Tense

When I entered Parliament in 1976 as the only female member, I took a stand and managed to do what many countries have failed to do ,or are threating to undo: decriminalise abortion.

I found the above line in Guardian. My question is - why " many countries have failed to do" & " are threating" here?.Shouldn't it be" had failed " &" were threating" as it indicated past act?

No, the countries have still failed and are still threatening now.
