Sometimes it just depends on how you want to say it huh!?

I'd almost always use the present tense, if you're speaking to the person. The only time I'd use the past tense is if you're referring (by written communication, or possibly by phone) to some past meeting at which you made the observation. You could also use the present tense in the case of written communication when that's the only type of communication you have with this person.
