Sitting vs seated

Hi, please help me.

"He was seated with his legs crossed."
"He was sitting with his legs crossed."

These sentences have different meanings?

For me they create different images:-

"He was seated with his legs cossed." - someone is sittng on the floor in the lotus position (like the Buddha), and not looking as though they are about to move.

"He was sitting with his legs crossed." - someone is sitting on a chair with one knee over the other, but I wouldn't be surprised if he stood up a minute later.

To my ear, if I had to allow only one gentleman a chair, it would be the one who is seated.
