Shouldn't it be were and would as it seems a hypothetical sentence?

The sentence below is from TODAY newspaper. It is from New Delhi. It is in relation to a rape victim who was studying to become a physiotherapist.

Her dad said, "If they are not hanged, it will be a shame for everyone in New Delhi."

Shouldn't it be were and would as it seems a hypothetical sentence?
