Should "identify" be "identifies"?

Context:

(2) notwithstanding the labeling lauguage required by 9 V.S.A. 3043(a), a requirement that a label required under 9 V.S.A. chapter 82A identify food produced entirely or in part from genetic engineering in a manner consistent with requirements in other jurisdictions for the labeling of food, including the labeling of food produced with genetic engineering.

Whoever wrote this is following the [ old-fashioned(?) ] rule that the subjunctive is needed after words like 'requirement'. It is largely disregarded these days, but people like me still use it quite often.
