There are two different views to make judgments of the crime. Some argue that every crime should be certain penalties while others believe that some factors can be influenced on committing crimes so judges should be discover when they want to make decisions.
On the one hand, certain punishment for each crime have acceptable roles to play in societies. Firstly, justice system can decide issues not only easily but also rightly. Indeed, people who record different verdicts about crime are aware about specific punishment so they rarely make decisions different from main once. Secondly, fixed penalties can deter criminal activities. If everyone is known for punishments before commiting, certainly they would be cautious about participating in aggressive actions. As a result, mankind keep away from criminal activities.
On the other hand, I would argue that the condition of a crime and the criminal's stimulus should have an influence on the punishment. One of the significant effect is judges can make decisions humanly. If judges attend to impressive elements that they can play main roles to occur crime's situation therefore penalties will be changed according to the particular status of offences. For example, q person who steal some money since he want to provide feed for his family while a person who filch a good deal of money to extend his own wealth. I believe, there is no doubt when the juries of court indagate about each reason of two people, they will hand down different sentences.
In summary, although the consequences of fixed penalties, it seems to me that each crime should be judged taking both the circumstances and reasons into account.
