"...is having to rethink how..."

The European Commission is having to rethink how it can maintain farmers' incomes while cutting costs and excess production.

Could you please tell me why it is 'is having to rethink' instead of 'is rethinking' ? Also, could I say 'the way it can maintain ...' instead fo 'how it can maintain...' ?

continuous aspect suggests that they are to rethink it now and they are rethinking. The difference is the same as between the Present Indefinite and Present Cont. forms.
