Provision antonyme

Hi.

Imagine a situation that you expected someone to send you something according to an agreement and they didn't send you anything.

I want to write something like:

"We are determined to take legal steps to claim refund of any loss caused by any further _____"

I can't find the right word. I was thinking of antonym of "provision" but my dictionaries are too short for this.

I was considering "not providing the goods we agreed on", however the "not providing" part doesn't seem to sound fine.
