preposition followed by gerund

Ex. The people would still be afraid of the snake
without it having to harm them.

In my EFL coursebook, the underlined part is viewed as a participial construction. However, I very much doubt if it is really so. Rather, it seems more like a gerundive construction preceded by a preposition.
What do you think about it?
