It is argued that the punishments for each type of illegal behavior should be fixed, while some people believe that there should make a consideration about the criminal’s context and reason before imposing the punishment on any offenders. From my perspective, I agree on the second view because it is reasonable and equal.
On the one hand, some people think that each type of crime should have a fixed penalty because it is easy for the court to judge and the society to understand. The court have a list of crime types and their own punishment based on the level of severity. If there are any criminal case that occurs, the court will base on the available punishment to impose on the crime, and everyone know this. In some countries, for example, if a case is similar to the previous one, the same punishment would be applied without the lawyer.
On the other hand, I believe that a flexible punishment for each criminal case would be more reasonable and equal to everyone when depending on the circumstance and motivation. In each criminal case, the court would investigate the criminal scene to evaluate the level of the offender’s humanity before making a decision about the sentence, which is equal for the crime. The court also takes the motivations of each crime into consideration to make sure that whether her or his behaviors is suitable with the moral standard of society or not. In two cases of murdering, for instance, the murderer abandoned, abused and tortured a child for a long time should have a severe sentence than the one who just murders the child by accident.
In conclusion, although some people think that there should be fixed punishments for each criminal case, I believe that considering the circumstance and the motivation before imposing the sentence on the crime would be reasonable and equal.
