After many crimes people often argue and there are two figures. Some people believe that there should be fixed punishments for each type of crime. Others, however, argue that the circumstances of an individual crime and the motivation for committing it, should always be taken into account when deciding on the punishments is better, that I tend to agree.
On one hand, fixed punishments can make it easier to sentence a crime. Sentences for a crime often lasts about 2 or 3 years or even more than 5 years. For instance, the Alibaba case - a fraudulent case in Viet Nam takes nearly 5 years to be judged and still not be sentenced. In addition, a fixed crime is easy to be loopholed. Criminals often rely on this to minimize the fines. This makes people disappointed and disgruntled.
On other hand, when the circumstances of an individual crime, and the motivation for committing it are taken into account when deciding on the punishment may take longer time but it will be more equal. In some cases, the criminals are still under 18, a suitable sentence will help them grow up like normal other friends. With considerable punishments, people with different levels in committing crime will be fined at different levels. In my own opinion, I think crimes which are taken into account may last a long time. However, they are often better and more equal, more humanized.
In conclusion, a fixed punishment will take shorter time to sentence a crime however, it will leave loopholes that criminals can rely on. A punishment that is taken into consideration is a more equal punishment.
