Professor Farajiha:
In two previous working group we have confirmend some principles to use for the council law draft law in criminal causes.
The general consensus of members:
1. The member of group working have been confirmed that the current council drafted law has some technical problem, we should scrutinize and complete this.
2. The current drafted law had focused on civil causes, but the traditional council they are solving criminal causes too, most of the time the decisions of tribal councils are opposite to Islamic law and other rule and regulation. So with the law the tribal councils face to some legal restrictions and responsibilities.
3. The current approved principles which have been approved by group working is should scrutinize very careful, when we use these principles for the tribal council draft law, it should not be against Islamic law, rule and procedures.

Judge Hazrat gul Hesami/ SC:
In the violenc agains women law its said: when the victim forgive then the criminal file will stop.
Lutfurrahman Saeed/ ICIC
When the group working draft the law so, we should mention what articile of criminal code should amendment.
Seddiqi/ ministry of tribe:
Some of the time when the women couldn’t participate in the traditional meeting, so she can introduce her delegate.
Kabir/ MoJ:
When the tribal council solve the problem, if the tribal council decision not accepatal for parties so the parities can protest.

Based on restorative justice principles, satisfaction of both parties are so important.

Members of the traditional councils are respectable people, so they will try to be voluble in the society.

Member of the tribal council consult some issues with litigants before cession.

We should reform the decisions of tribal councils mistakes. The satisfacations of ligitants are som important.

According the restorative justice principles the unlawful agreement by tribal council are not acceptable, on the most important benefite of the code and law is that the irregularities should stop by law.

I know some experience of Behrain country regarding restorative justice, in that country some times when the litigants doesn’t wants to visit face to face each others, so they would like to exchange their wishes and massages by delegates.

Restorative justice should not be like formal justice, it means the decision should share with the litigants before the final decision.
Shafiullah Shafiee/ Ulama Council:
In the Nooristan province the member of tribal council in some large causes they visit with legitimate before the final decision with the litigants.
Professor Farajiha:
I would like to say you the Indian experience regarding Juvenile Delinquent , in india if the child be 12 years old, he or she will not need to legal guardian.

in the formal justice without parents we can’t get decision.

The child abuse law is under working, this is the better time that we should include restorative justice issues.

Suggestions and proposlals or working group members:
1. For the next and final group working we should discuss all drafted articles in large meeting it means in our meeting should participate from civil society network although some of the civil society members participated .
2. For the final group working we should have 25-25 participants for 2 -2 days and one day with small group with some specialist.
3. if the articles completed and jerala drafted law completed the project should continue to defense from this law.
