Besides doctors are generally reluctant to declare ICU patients brain dead and facilitate donation. Also, there aren't too many hospitals authorised to perform transplants. While the Transplantation of Human Organs Act of 1994 allows even those related emotionally to the recipient to donate. However, it is a loophole, which racketeers generally exploit.

To declare someone brain dead is to (for a doctor) to state formally that there has been "irreversible brain damage and loss of brain function, as evidenced by cessation of breathing and other vital reflexes, unresponsiveness to stimuli, absence of muscle activity, and a flat electroencephalogram for a specific length of time."
