Are all sorts of ‘past modal verb + have + p.p.’ counterfactual conditionals?

Examples from Harry Potter and the Sorcerer's Stone and their counterfactual conditionals I made:

Professor McGonagall was almost speechless with shock, and her glasses flashed furiously, "- how dare you - might have broken your neck -"
: If you had crashed onto the land, you might have broken you neck.

How could he have been so stupid?
: Even if he had been able to be not stupid, how could he have been so stupid?
