"Open Water" stank like dead fish

What was the deal with the opening slate stating that the film was "based on a true story"? How do they know what happened to the couple while they were out in the water, since they both died!

I mean, nobody survived to tell the story! So how could they claim the film was based on a true story! Everything that happened after the couple left the boat was pure conjecture!

I know the camera was found in the shark's stomach, but IIRC, the couple didn't take any pix while waiting to be rescued. As far as we know, they could have strangled each other in a lovers' quarrel, as opposed to being eaten by sharks.

Because they found their gear. They presume that they removed their gear because they became confused due to exposure,
