'on the average' or 'on average'

"If any contracting party establishes a monopoly of the importation of any product described in the schedule, such monopoly shall not operate so as to afford protection on the average in excess of the amount of protection provided for in that schedule."

1) Shouldn't there be an 'a' in between 'such' and 'monopoly'?

2) I thought 'on average' was the correct phrase? Am I wrong?
