Of vs with

In this sentence which would you use. Could it be both of them?
  • One of the main problems of/with the Canadian Bill of Rights was that the courts relied on parliament to enforce the laws.

I'm guessing that it would be an error in tense.

"with" "was"
"of" "was"

Wouldn't "of" mean pretense and "was" past tense?

Yes you're probably right thinking about it. To me, we say it that way because we do - sorry for not being scientific about it.
