I suppose it's an attempt at a pun (headline writers are very keen on puns). "not up in the air" literally means "not flying on the plane" (like the smelly passenger). "up in the air" is also an idiom meaning "undecided", and I suppose the story is discussing a matter which is undecided, or open to different opinions from different people.
