Thanks a lot once again for reading my post and helping me.==Dear SuperintendentI would like to inform you that on Friday Feb 10, 06 I heard a banging noise in my floor coming from apt below mine which is 501 when I was washing dishes in the my apt Kitchen area. Minutes later someone come to my apartment and smash my door with a heavy subject and the noise was so loud and terrorized me.I immediately call emergency phone number that you provided in your door and I explain to the deputy superintended of what had happened and asked her to talk with the person who live in apt 501 to see why he had done such an unacceptable action. He basically was trying to terrorize me. I was only washing dishes. I was planning to call the police as I can not tolerate such violent and rude behavior. However the lady on the duty has suggested to not take the matter now to police.I would like to talk to him again and explain to him such act would never been tolerated by me. If he does that again I would inform you first then call the police immediately after. Then I would talk with property manger and demand the lease to be broken as I can not live with such terrorized environment. I would explain the rental board the situation and I am sure they would support my claimRegardsMyname

On Friday Feb 10, 06 I heard a banging noise coming from 501; the apartment below mine. Minutes later someone came to my apartment and crashed on my (front?) door.
I immediately called your emergency phone number and told the deputy superintended what had happened. I asked her to talk to the person who lives in apt 501 to see why he had done it.
I was planning to call the police, however the deputy suggested not to. I am not sure I was correct to go along with this advice, however if you can resolve the matter I will let it rest at that.

If this happens again I must demand to be released from our contract as I can not be expected to live in such an environment.

I'd have a word with the cops before you take matters into your own hands and fall foul of the law. Get something on file somewhere neutral such as the local busy's.

Before you write any letter, tell your story orally to the building superintendent and ask him how to proceed. Your draft complains that the occupant of #501 damaged your door. But (1) You did not use the right legal words to complain. Your lease probably promises "peaceful enjoyment" of the apartment, and this is what the noise prevented.
(2) You did not indicate how you know the offender was the occupant of #501. Your complaint is enfeebled if you complain about the wrong person. If you have other reasons to suppose #501 is persecuting you, these
reasons should appear in your letter.

I've put up with this sort of thing from a neighbour from **** for years. It is so bad that the woman in the flat below me insists I am the culprit. It's the man above. He is either on depressants or drinks. Probably both.
In my case you could almost set your clock by him. He kicks off with a nasal singing or yelling abuse aout the window.And soon he starts pounding whatever article of furniture grabs his attention. If you go and knock on his door he will not answer but watches his step for the next few days.
I don't know why I put up with it so long. I suppose I can empathise somewhat, having a touch of the black dog myself now and again.

I feel like killing him sometimes. If you let it simmer you will eventually do something irrational, so get it sorted peacefully asap if you can. By all means if you know anyone with the same problem encourage them to talk it over with someone in authority.

If the tenant below has a case of bad nerves for whatever reason and takes offense at the sound of someone upstairs just crossing the room, I suppose he will feel justified in doing seriously stupid things one day.
You don't have to put up with it.

I think you and I were the distinct minority on this topic, Ray. I gave the same advice on AUE in response to the same original post, but everyone else answered with "how to write a letter to begin or bolster a legal case to break the lease." When I saw the topic "neighbor terrorized me", I thought the same way you did: If this is a sincere thought, then call the police! If "terrorized" really means "annoyed", then sure, there's a letter to be written, and someone should read about the little boy and the wolf.
Fortunately, my neighbors are seldom worse than annoying, and generally pretty nice, really.
