Violence, Marriage, and Family Honour: Aspects of the Legal Regulation of Marriage in New France.

Argument: Women in the 17th and 18th century played an important role in New France. However, there were punished for their unacceptable behaviour than men did.

Main Points: In the 17th and 18th century marriage in New France was considered as a valuable foundation of society and strictly overseen by the church and the state. There were many similar cases in different areas, however, the authors of this study focused in the St. Lawrence Valley. During that period of time, there were many problems. Such as threat to marriage, because marriage was extreme important, young people were pressured to get married. Only church marriage was recognized at that time. It was hard for a woman to apply for application for separation, although she was unhappy in her marriage. She would have to do it with the permission of her husband. However, if a husband was proved not caring for his family or property, a wife could apply for a separation of property, and separation of bed and board. For instance, bed and board would be physical abuse. Neither of the application was not that easy to apply. Husband physically abused his wife was normal, and was considered as discipline. In order, the application to be accepted, women would need to provide strong evidences, such as neighbour who witnesses the abuse. In addition, committed adultery was not considered as a serious matter. Women were forbidden to apply for adultery separation alone. The complaint toward the husband supposed to be more than one for separation to be granted. Last, Family reputation was very important. In New France, the community was watching each other behaviours. In some cases, judges would use neighbours to find out the accused reputation.

Evidence: Because of the time period, women had no rights as men. Though in the 19th century, slowly women rights started to change for better. For example, more women were educated. As a result, women had opportunity outside the domestic sphere. Also, women who applied for a separation as to property were more educated in contrast to bed and board.
