Need advice: Parenthetical phrase as modifier to sentence

It is not clear to me whether the following sentence is modified in whole or only in part by the parenthetical phrase. Specifically, does it refer to all costs, or only legal? I would appreciate some knowledgable advice on this question.

“XYZ’s costs should be limited to out-of-pocket, due diligence and legal (which shall not exceed $60,000 without your prior written consent)”

In my opinion it is impossible to know the answer. I can only guess that the total of all types of costs shall not exceed $60,000 since limits are not set on the other types, but I would check it out carefully before signing anything!
