Meaning of "taken out"

A lot of legal documents include the "taken out" phrase.
For example,
I am now concerned with the Plaintiff’s application taken out in November 2008 to vary the Consent Taxation Order.
What does it by "taken out"?
Please help. Thanks.

I wonder why "apply" isn't often used in the legal documents.

Well, for one thing, you wouldn't want to write 'the application was applied for'. Otherwise, I suppose that it has just become a set phrase.
