Major issues

I didn't know you have to do that....

I didn't know you had to do that...

I'm having a major fit with the verbs had/have. I know one is in the past tense and the other is the present form. But when I read the two sentences above they sound identical to me..

The only difference I can distinguish from the two had/have is that had happened before have...but other than that what's the difference?

Like: I didn't know you had money on you. I didn't know you have money on you. Please help.

Since the sentence starts with I didn't shouldn't it be followed by had instead of have?

EG:

I didn't know you had this game.

I didn't know you have this game. (I'm holding a game that I didn't know this person had during the present) So would have be applicable in this situation?
