Looking for a word

I am looking for the exact words used for a person or a vehicle which is responsible in accident and the one who is not guilty.

I mean when an aciddent happens between two vehicles, a police officer shows up and makes the judgment and consider one of the driver-----------and the other -----------.

I can think of faulty, guilty , culprit, lawbreaker.

I would be grateful if you would tell me the right words for each side in accident.

Hi, Where I live, this is what we usually say. eg The police charged the driver of the red car. eg The insurance company decided that the driver of the red car was (not) at faul t.

Where I live, this is what we usually say.
eg The police charged the driver of the red car.
eg The insurance company decided that the driver of the red car was (not) at fault.
