Letter to landlord about bad neighbour

HiI want to send this letter to my landlord complaining about really bad neighbour. Could you please review this letter for me and rewrite it so I can present my case strongly. It has been almost every day I heard a very loud and so intimating banging noise coming from the apartment below mine. The usual reason for banging on a ceiling is to complain about the noise from the apartment above. Are you sure that you are not at fault in this? Is there anything that triggers this banging? Does it occur whenever you play your TV or stereo? Do you have small children running around on uncarpeted floors?

"Smashed" implies that he made an actual hole in the door, which sounds like grounds for calling the police, not writing a letter to the landlord. Since you did not call the police, and the landlord was apparently unconcerned about damage to his door, it seems that "smashed" is too strong a word. And how do you know he used a heavy object?

Do you have a lease? If so, you may be liable for the rent whether you live in the apartment or not.

or better yet, intimidating. Although I'm not sure it's even the right word. Most noises in nearby apartments aren't directed at people in other apartments, although just below you give a good hypothesis.

Or even adults doing mild walking. Leases in many places require a substantial percentage of the floors be covered by carpet or rugs.

When I first got a place in Brooklyn, my downstairs neighbor complained about my attempts at piano playing. I'd been trying for 15 years but was still pretty bad. This guy had both a piano and a large organ in his apartment, and he told me he tuned organs for a living, so i can understand that he was picky. My next door neighbors liked my piano playing they went out of their way to tell me so I always ended with Smoke Gets in Your Eyes, which they said they liked, and so that they would know I was done for the day, not just stopping to ansewr the phone, for example. I think we had cement walls between apartments but I didn't think that then. I don't know how well they heard me.
Eventually he found in the elevator a note offering a free rug, and he took off the note and gave to me. I got the "persian style" rug, and left it folded so it was about 12 layers thick and I put that underneath my spinet piano.
At the end of the year I moved upstairs, and not too long after that, another neighbor said that he had never complaining about me. When the woman below him was dying, he kept playing his piano and/or organ, at inappropriate times, according to my other neighbor. I was sure he'd deny it so I never discussed it with my former downstairs neigbhor.

If there is damage to the door, and the OP has a witness that the n'bor did it, that should be high up with the other complaint. It's tangible, can be seen. Even if he doesn't have a witness, if he somehow "knows" it was the n'bor, it should be up there with the noise complaint. Although if he's really moving out, and not trying to get the ll to intervene with the n'bor, maybe it makes no difference.

Absolutely. The OP may have a lease that has expired and without a new lease, he may be a month to month tenant, in which case in many jurisdictions, the ll can kick him out on 30 days notice or he can move on 30 days notice, although this really means if it's December 15, he must give notice by Dec 31 that he's moving out Jan 30th. If he gives notice on the 15th, that doesn't mean he can move on the 15th of January and not pay rent for the rest of the month. Details too numerous to mention omitted.
Or he may be in the middle of a lease. Maybe the landlord will agree to a subtenant, which he will have to find, or maybe he can find the ll a new good tenant, or maybe for a fee, the landlord will let him out of the lease.
He seems to be syaing he has been constructively evicted because of the noise, but I'm not sure he has been and even if he does meet the standard, I doubt he has near enough information or proof to win in court. It takes a lot to show constructive eviction.

[nq:2]prevents "quiet enjoyment." Thanks[/nq]Rather than just saying thanks, I'd be more supplicative (right word?) You need his cooperation now more than before. You may have an obligation under the lease that he might waive, but a forceful letter may make him stiffen his back. Be sure to leave the apartment "broom clean" or better, as good as it was when you got it, not counting what is callled normal wear and tear, with the emphasis on normal, and take pictures and be sure to have a walk-through as is the practice where you live.

Check up on local procedures to avoid lowing more of your security deposit than you should, or from being sued for even more than that. Most landlords are honest, but many get burned by their tenants a lot, and thinging they're being burned again brings out the worst in them.
