Just a tiny question

Here's the passage I saw:"The police entered Mr. Owen's house, they overhauled his papers and impudently took down the red flag he had in house, the one he had the same right that you have to have a green or blue one."
My questions is, isn't the pronoun that supposed to be replaced by as?
I think it's more correct that way, am I right?
And I even think that the clause should be "the one he had the same right to have as you do to have a green or blue one."
