joint tenancy or tenancy in common

if a will for tom and john is read equal shares absolutely, does this means tenancy in common, or joint tenancy?

This appears to be a legal question rather than a grammar question, but I would think it would be tenancy in common, unless the will specifies that it should be joint tenancy.
