Is the sentence correct to say.

I wonder whether below sentence is correct or not. Please help me.

The court ordered that the child should stay under her mother's custody. ( not using subjunctive mood)

In BrE both "should stay" and "stay" are OK. I believe that the "should" version is not used much in AmE. Normally you stay in someone's custody, not under.

In BrE both "should stay" and "stay" are OK. I believe that the "should" version is not used much in AmE.

Normally you stay in someone's custody, not under.

We do use it in AmE, but from what I've observed, not anywhere near as much as in BrE.
