is or was?

Hi. Song lyrics don't always use proper grammar. But I'm working on a rock song lyric and would like to know which of these two sentences is correct or "more correct":
The only thing Jesse James would give is a bullet in the head.
The only thing Jesse James would give was a bullet in the head.

Without more context, the first one is better. The second, the past tense, is grammatical, but it's kind of hitting you over the head with the fact that James is dead and buried.
