According to the third definition of http://www.merriam-webster.com/dictionary/less from the Merriam-Webster dictionary, I would guess it's a noun.

1 : a smaller portion or quantity
2 : something of less importance

MWEDU say it's a pronoun in "10 items or less".

As for using "fewer" over "less", there is nothing grammatically incorrect with the latter.
