Interpretation of sentence

Shouldn't it be where in this sentence instead of and. I wish to say that the Court of Appeal remitted case back to the lower court. The lower court ordered the defendant to pay damages.

The Court of Appeal remitted the case back to the lower court and the defendant was ordered to pay damages.

I feel if we use and then it will mean that the Court of Appeal ordered the defendant to pay damages.
