Does the scope of the phrase 'including but not limited to" in the following apply to just the list before the next comma or are the following just one of the elements of the list? In other words is this phrase about all intellectual property rights without limitation or is the phrase indicating a limitation to that used in the products joint developed? Why should this be read one way vs the other?
"all intellectual property rights, if any, including but not limited to all copyright interests and all patent licensing rights, to the software, processes, methodologies, circuitry and designs used in all of the products joint developed pursuant to the agreement and its amendments.”
